The Committee is concerned that certain provisions in domestic law and practices of the State party do not conform to article 3 of the Convention, and in particular:\n<\/span>\n\n<span style=\"font-family: arial, helvetica, sans-serif; font-size: 12pt;\">a) 2006 \u5e74\u51fa\u5165\u56fd\u7ba1\u7406\u53ca\u3073\u96e3\u6c11\u8a8d\u5b9a\u6cd5\u306f\u3001\u62f7\u554f\u3092\u53d7\u3051\u308b\u53ef\u80fd\u6027\u304c\u3042\u308b\u56fd\u3050\u306b\u3078\u306e\u9001\u9084\u3092\u660e\u78ba\u306b\u7981\u6b62\u305b\u305a\uff1b\u52a0\u3048\u3066\u3001\u518d\u5be9\u67fb\u6a5f\u95a2\u306f\u6761\u7d04\u7b2c3 \u6761\u306e\u9069\u7528\u3092\u5236\u5ea6\u7684\u306b\u8abf\u67fb\u305b\u305a\uff1b\n(a) The 2006 Immigration Control and Refugee Recognition Act which does not expressly prohibit deportation to countries where there is a risk of torture; in addition, reviewing authorities do not systematically investigate the applicability of article 3;\n<\/span>\n\n<span style=\"font-family: arial, helvetica, sans-serif; font-size: 12pt;\">b)\u00a0\u96e3\u6c11\u8a8d\u5b9a\u306e\u8a72\u5f53\u6027\u3092\u518d\u5be9\u67fb\u3059\u308b\u72ec\u7acb\u3057\u305f\u6a5f\u95a2\u306e\u6b20\u5982\uff1b\n(b) The lack of an independent body to review refugee recognition applications;\n<\/span>\n\n<span style=\"font-family: arial, helvetica, sans-serif; font-size: 12pt;\">c)\u00a0\u591a\u6570\u306e\u66b4\u884c\u306e\u7591\u3044\u3001\u9001\u9084\u6642\u306e\u62d8\u675f\u5177\u306e\u9055\u6cd5\u4f7f\u7528\u3001\u8650\u5f85\u3001\u6027\u7684\u3044\u3084\u304c\u3089\u305b\u3001\u9069\u5207\u306a\u533b\u7642\u3078\u306e\u30a2\u30af\u30bb\u30b9\u6b20\u5982\u3068\u3044\u3063\u305f\u4e0a\u9678\u9632\u6b62\u65bd\u8a2d\u53ca\u3073\u5165\u56fd\u7ba1\u7406\u5c40\u306e\u53ce\u5bb9\u30bb\u30f3\u30bf\u30fc\u3067\u306e\u51e6\u9047\u3002\u7279\u306b\u3001\u3053\u308c\u307e\u3067\u306b1\u00a0\u4ef6\u306e\u307f\u304c\u5165\u56fd\u7ba1\u7406\u53ce\u5bb9\u30bb\u30f3\u30bf\u30fc\u3067\u306e\u8650\u5f85\u3068\u3057\u3066\u8a8d\u3081\u3089\u308c\u3066\u3044\u308b\u306b\u3059\u304e\u306a\u3044\u3053\u3068\u306b\u59d4\u54e1\u4f1a\u306f\u61f8\u5ff5\u3092\u6709\u3059\u308b\u3002\n(c) The conditions of detention in landing prevention facilities and immigration detention centres, with numerous allegations of violence, unlawful use of restraining devices during deportation, abuse, sexual harassment, lack of access to proper health care. In particular, the Committee is concerned that, so far, only one case in such a detention centre has been recognized as ill-treatment.\n<\/span>\n\n<span style=\"font-family: arial, helvetica, sans-serif; font-size: 12pt;\">d)\u00a0\u5165\u56fd\u7ba1\u7406\u53ce\u5bb9\u30bb\u30f3\u30bf\u30fc\u53ca\u3073\u4e0a\u9678\u9632\u6b62\u65bd\u8a2d\u3092\u72ec\u7acb\u3057\u3066\u76e3\u8996\u3059\u308b\u30e1\u30ab\u30cb\u30ba\u30e0\u306e\u6b20\u5982\u3001\u7279\u306b\u88ab\u53ce\u5bb9\u8005\u304c\u5165\u56fd\u7ba1\u7406\u5c40\u8077\u54e1\u306b\u3088\u308b\u66b4\u884c\u5bb9\u7591\u306b\u3064\u3044\u3066\u7533\u7acb\u3066\u3067\u304d\u308b\u72ec\u7acb\u3057\u305f\u6a5f\u95a2\u306e\u6b20\u5982\u3002\u307e\u305f\u3001\u7b2c\u4e09\u8005\u3067\u3042\u308b\u96e3\u6c11\u53c2\u4e0e\u54e1\u306e\u4efb\u547d\u57fa\u6e96\u304c\u516c\u8868\u3055\u308c\u3066\u3044\u306a\u3044\u3053\u3068\u306b\u3082\u59d4\u54e1\u4f1a\u306f\u61f8\u5ff5\u3092\u6709\u3059\u308b\uff1b\n(d) The lack of an independent monitoring mechanism for immigration detention centres and landing prevention facilities, and in particular the lack of an independent agency to which detainees can complain about alleged violations by Immigration Bureau staff members. The Committee is also concerned that the criteria for the appointment of third-party refugee adjudication counsellors are not made public;\n<\/span>\n\n<span style=\"font-family: arial, helvetica, sans-serif; font-size: 12pt;\">e)\u00a0\u6cd5\u52d9\u7701\u306f\u96e3\u6c11\u8a8d\u5b9a\u7533\u8acb\u8005\u306b\u5bfe\u3057\u3001\u7570\u8b70\u7533\u7acb\u3066\u306e\u969b\u306e\u6cd5\u7684\u4ee3\u7406\u4eba\u3092\u9078\u4efb\u3055\u305b\u305a\u3001\u975e\u6b63\u898f\u6ede\u5728\u8005\u306b\u5bfe\u3059\u308b\u653f\u5e9c\u306b\u3088\u308b\u6cd5\u7684\u63f4\u52a9\u304c\u4e8b\u5b9f\u4e0a\u306f\u9650\u5b9a\u7684\u3067\u3042\u308b\u4e8b\u5b9f\u3092\u8e0f\u307e\u3048\u3001\u5165\u56fd\u7ba1\u7406\u5c40\u8077\u54e1\u306b\u3088\u308b\u88c1\u5b9a\u3092\u518d\u5be9\u67fb\u3059\u308b\u72ec\u7acb\u3057\u305f\u6a5f\u95a2\u306e\u6b20\u5982\u3002\n(e) The lack of an independent body to review decisions by immigration officials, in light of the fact that the Ministry of Justice does not allow refugee recognition applicants to select legal representatives at the first stage of application, and governmental legal assistance is de facto restricted for non-residents;\n<\/span>\n\n<span style=\"font-family: arial, helvetica, sans-serif; font-size: 12pt;\">f)\u00a0\u5168\u3066\u306e\u5e87\u8b77\u5e0c\u671b\u8005\u306e\u53f8\u6cd5\u5be9\u67fb\u3078\u306e\u30a2\u30af\u30bb\u30b9\u4fdd\u969c\u306e\u4e0d\u5341\u5206\u6027\u3068\u884c\u653f\u624b\u7d9a\u7d42\u4e86\u76f4\u5f8c\u306b\u9001\u9084\u3092\u57f7\u884c\u3057\u305f\u7591\u3044\u3002\n(f) Insufficient guarantees of access to judicial review for all asylum-seekers, and allegations of deportations carried out immediately after the administrative procedure has ended;\n<\/span>\n\n<span style=\"font-family: arial, helvetica, sans-serif; font-size: 12pt;\">g)\u00a0\u96e3\u6c11\u7533\u8acb\u5374\u4e0b\u5f8c\u304b\u3089\u9001\u9084\u307e\u3067\u306e\u5e87\u8b77\u5e0c\u671b\u8005\u306e\u7121\u671f\u9650\u62d8\u675f\u3001\u7279\u306b\u7121\u671f\u9650\u53ca\u3073\u9577\u671f\u306e\u53ce\u5bb9\u30b1\u30fc\u30b9\u306e\u5831\u544a\u3002\n(g) The undue length of time asylum-seekers spend in custody between rejection of an asylum application and deportation, and in particular reports of cases of indefinite and longterm detention;\n<\/span>\n\n<span style=\"font-family: arial, helvetica, sans-serif; font-size: 12pt;\">h) 2006\u00a0\u5e74\u5165\u7ba1\u6cd5\u6539\u6b63\u306e\u969b\u306b\u5c0e\u5165\u3055\u308c\u305f\u4eee\u6ede\u5728\u5236\u5ea6\u306e\u53b3\u6b63\u6027\u53ca\u3073\u9650\u5b9a\u7684\u306a\u52b9\u679c\u3002\n(h) The strict character and limited effect of the provisional stay system adopted in the revised 2006 Immigration Law.<\/span>\n\n<span style=\"font-family: arial, helvetica, sans-serif; font-size: 12pt;\">\u3014\u7565\u3015<\/span>\n\n<span style=\"font-family: arial, helvetica, sans-serif; font-size: 12pt;\">\u7de0\u7d04\u56fd\u306f\u3001\u79fb\u6c11\u306e\u53ce\u5bb9\u3068\u9001\u9084\u306b\u95a2\u9023\u3059\u308b\u5168\u3066\u306e\u63aa\u7f6e\u3068\u904b\u7528\u306f\u3001\u6761\u7d04\u7b2c3\u00a0\u6761\u306b\u5341\u5206\u306b\u9069\u5408\u3059\u308b\u3088\u3046\u306b\u4fdd\u969c\u3059\u308b\u3079\u304d\u3067\u3042\u308b\u3002\u7279\u306b\u7de0\u7d04\u56fd\u306f\u3001\u9001\u9084\u3055\u308c\u305f\u5834\u5408\u3001\u62f7\u554f\u306e\u5bfe\u8c61\u3068\u306a\u308b\u5371\u967a\u306b\u3055\u3089\u3055\u308c\u308b\u3068\u4fe1\u305a\u308b\u5341\u5206\u306a\u6839\u62e0\u304c\u3042\u308b\u56fd\u3050\u306b\u3078\u306e\u9001\u9084\u3092\u660e\u78ba\u306b\u7981\u6b62\u3057\u3001\u96e3\u6c11\u8a72\u5f53\u6027\u3092\u518d\u5be9\u67fb\u3059\u308b\u72ec\u7acb\u3057\u305f\u6a5f\u95a2\u3092\u8a2d\u7f6e\u3059\u3079\u304d\u3067\u3042\u308b\u3002\u7de0\u7d04\u56fd\u306f\u96e3\u6c11\u7533\u8acb\u53ca\u3073\u9001\u9084\u624b\u7d9a\u304d\u306b\u304a\u3051\u308b\u9069\u6b63\u624b\u7d9a\u304d\uff08due process\uff09\u3092\u4fdd\u969c\u3059\u308b\u3079\u304d\u3067\u3042\u308b\u3002\u7de0\u7d04\u56fd\u306f\u5165\u56fd\u7ba1\u7406\u53ce\u5bb9\u65bd\u8a2d\u306b\u304a\u3051\u308b\u51e6\u9047\u306b\u95a2\u3059\u308b\u4e0d\u670d\u7533\u7acb\u3066\u3092\u5be9\u67fb\u3059\u308b\u72ec\u7acb\u3057\u305f\u6a5f\u95a2\u3092\u9045\u6ede\u306a\u304f\u8a2d\u7f6e\u3059\u3079\u304d\u3067\u3042\u308b\u3002\u7de0\u7d04\u56fd\u306f\u3001\u7279\u306b\u5f31\u3044\u7acb\u5834\u306b\u3042\u308b\u4eba\u3005\u304c\u9001\u9084\u3092\u5f85\u3064\u9593\u306e\u53ce\u5bb9\u671f\u9593\u306b\u4e0a\u9650\u3092\u8a2d\u7f6e\u3057\u3001\u66f8\u9762\u306b\u3088\u308b\u9001\u9084\u547d\u4ee4\u767a\u4ed8\u4ee5\u5f8c\u306e\u53ce\u5bb9\u306e\u5fc5\u8981\u6027\u306b\u95a2\u9023\u3059\u308b\u60c5\u5831\u3092\u516c\u958b\u3059\u3079\u304d\u3067\u3042\u308b\u3002\nThe State party should ensure that all measures and practices relating to the detention and deportation of immigrants are in full conformity with article 3 of the Convention. In particular, the State party should expressly prohibit deportation to countries where there are substantial grounds for believing that the individuals to be deported would be in danger of being subjected to torture, and should establish an independent body to review asylum applications. The State party should ensure due process in asylum applications and deportation proceedings and should establish without delay an independent authority to review complaints about treatment in immigration detention facilities.
